These terms govern all purchases made through oleaandhound.com. By placing an order you confirm that you have read, understood, and agree to these terms. Please read them before you buy.

1 · Who we are

Olea & Hound is a brand registered in Malta under company number C 102212, VAT registration number MT29182301.

When these terms say "we", "us", or "our" they mean Olea & Hound. When they say "you" or "your" they mean the customer placing an order.

2 · What we sell

We produce AI-generated fine-art pet portraits as high-resolution digital files (minimum 4096 px), delivered to your email address within seconds of a confirmed payment. All products are digital goods; no physical item is dispatched unless you have separately ordered a print (where offered).

Our current digital tiers, priced in euros (EUR), are:

• One style - €39: one 4096 px fine-art portrait in your chosen style, plus phone wallpapers.
• Three styles - €69: your three favourite styles, each at 4096 px, plus wallpapers.
• All six styles - €99: all six styles at 4096 px, plus wallpapers and a permanent shareable gallery.

Prices include any applicable VAT. We reserve the right to change prices at any time; the price displayed at the time you confirm your order is the price you will be charged. All transactions are processed in euros.

3 · Ordering & payment

A contract between you and us is formed when payment is confirmed by our payment processor. Before that point you may abandon your session at any time at no cost.

Payments are processed by Mollie B.V., a Netherlands-based payment institution regulated under PSD2 (licence DNB). Accepted methods include iDEAL, credit and debit cards (Visa, Mastercard), SEPA bank transfer, and other methods offered at checkout. We do not store your card or bank details.

4 · Delivery

Digital files are delivered by email within seconds of payment confirmation. If you have not received your files within ten minutes, check your spam folder, then contact us at [email protected].

Download links in your confirmation email remain valid for twelve months. After that period files may no longer be accessible; we recommend saving your files to a personal storage service promptly.

5 · Right of withdrawal and cancellation

Under EU Directive 2011/83/EU on Consumer Rights, you ordinarily have a fourteen-day right to withdraw from a distance contract without giving reasons. For digital content supplied over the internet, Article 16(m) of that Directive provides that the right of withdrawal is lost once performance has begun with your prior express consent and acknowledgement that you thereby lose your right of withdrawal.

At checkout, you are required to tick a box expressly consenting to immediate delivery and acknowledging that you waive your right of withdrawal once your files have been delivered. By ticking that box you confirm your consent.

6 · Likeness guarantee

If your finished portrait does not recognisably look like the pet in your photograph, contact us within fourteen days of delivery with one photograph showing the portrait next to your pet. We will refund 100% of your payment. There is nothing to return.

Refunds under the likeness guarantee are processed within three to five business days to your original payment method.

7 · Your photograph - licence and warranties

By uploading a photograph you confirm that you own the copyright to that photograph or have the right to use it for this purpose. You grant us a limited, non-exclusive licence to process the photograph solely for the purpose of generating your portrait and, where applicable, checking likeness quality. We do not use your photographs to train AI models, sell them to third parties, or use them for any purpose beyond fulfilling your order.

Uploaded photographs are stored on Cloudflare R2 for thirty days to allow session recovery and quality checks, then permanently deleted.

8 · Intellectual property in the generated portraits

Generated portrait files are licensed to you for personal, non-commercial use, including printing for personal display, sharing on social media, and giving as a gift. Commercial reproduction or resale of the files without our written consent is not permitted.

We retain ownership of the generation technology, prompting methodology, and style definitions used to produce the portraits. The portraits are not sold as works-for-hire.

9 · Acceptable use

You may not use our service to upload images that contain explicit sexual content, graphic violence, or material that is illegal in Malta or the European Union. We reserve the right to refuse or cancel any order that breaches this condition and to report relevant material to appropriate authorities.

10 · Limitation of liability

To the maximum extent permitted by Maltese law, our total liability to you in connection with any order is limited to the amount you paid for that order. We are not liable for indirect, consequential, or incidental losses, including but not limited to loss of data, loss of profits, or emotional distress, except where such liability cannot be excluded by law.

Nothing in these terms limits or excludes our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

11 · Consumer rights

These terms do not affect your statutory rights as a consumer under Maltese law or EU consumer protection legislation. Where any term conflicts with a right you have under applicable law, that statutory right prevails.

12 · Governing law & disputes

These terms are governed by the laws of Malta. Any dispute that we cannot resolve informally may be referred to the courts of Malta. If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in your country of residence.

13 · Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place your order is the version that applies to your purchase. We will not apply updated terms retroactively to existing orders.
